Abstract
Abstract In recent time, arbitration has emerged an important alternative dispute settlement mechanism for resolving commercial dispute in a speedy and cost-effective manner with emphasis on the confidentiality of the information to meet the requirement of growing international commerce and business. Indian government has also been promoting arbitration to make India a hub of international commercial arbitration. In this regard, the Arbitration and Conciliation act, 1996 has been enacted to replace the old Arbitration Act of 1940 to provide a comprehensive legal framework for both domestic as well as international commercial arbitration including enforcement of foreign award. The 1996 Arbitration Act is based on the UNCITRAL Model Law and is being updated with best international practices. This paper provides a critical appraisal of commercial arbitration landscape in India, including the key features of the Arbitration and Conciliation Act, 1996, government initiatives to promote arbitration and role of judiciary in facilitating and supporting emerging arbitration ecosystem through pro-arbitration stance in case laws.
