Abstract
The rapid expansion of the digital economy has profoundly altered standard concepts of competition and market dominance. Major tech platforms such as Amazon, Google, and Meta function within intricate, data-centric environments driven by multi-sided markets, network effects, and economies of scale. These unique characteristics allow such companies to secure and maintain market control in ways that older, traditional antitrust frameworks fail to adequately address.
In India, the Competition Commission of India regulates the abuse of dominant market positions under Section 4 of the Competition Act, 2002. However, because this legal framework was built for conventional industries, it struggles to manage modern digital offenses like data monopolization, algorithmic collusion, predatory pricing, and self-preferencing. Furthermore, traditional methods of calculating market share and defining relevant markets are often ineffective when applied to data-driven and "zero-price" digital services.
