Abstract
In the digital age, privacy has evolved from a personal prerogative to a contested legal right. This paper critically examines the development of privacy rights in India, focusing on constitutional recognition, legislative frameworks, and comparative international standards. It explores the implications of the Digital Personal Data Protection Act, 2023, and evaluates its effectiveness against global benchmarks such as the GDPR and HIPAA. The paper based in doctrinal research methodology concludes with recommendations for strengthening India’s privacy regime through institutional reform, public awareness, and legal harmonization.
